Guide
How discrimination claims work in California
FEHA
Broad state protection
California’s Fair Employment and Housing Act covers most employers with five or more employees, and harassment claims apply even with just one. It protects more traits than federal law, including sexual orientation, gender identity, marital status and genetic information.
3 yrs
File with the CRD first
Before suing under FEHA you must file an administrative complaint with the California Civil Rights Department, generally within three years of the last discriminatory act.
1 yr
Then a lawsuit deadline
Once the CRD issues a right-to-sue notice, you generally have one year from that notice to file your lawsuit in court. Missing it can end the FEHA claim.
EEOC
Federal claims run faster
Federal discrimination claims go through the EEOC, usually within 300 days in California, and suit generally must follow within 90 days of a federal right-to-sue notice.
Motive
Discrimination need not be the only reason
A firing or demotion can be unlawful even if it was based on a mix of legitimate and discriminatory reasons. Shifting explanations and patterns of treatment are common evidence.
Retal.
Retaliation is its own claim
Employers cannot punish you for complaining about discrimination, requesting an accommodation or taking part in an investigation, and retaliation can be pursued separately.

FAQ
Frequently asked questions
How long do I have to file a discrimination claim in California?
Under FEHA you generally have three years from the last discriminatory act to file with the California Civil Rights Department, then one year after receiving a right-to-sue notice to file a lawsuit. Federal claims through the EEOC have much shorter deadlines.
Do I have to file with the CRD before suing my employer?
Yes, for FEHA claims. You can ask the CRD for an immediate right-to-sue notice if you plan to go straight to court with a lawyer, in which case the department does not investigate.
What can I recover in an employment discrimination case?
Depending on the facts, remedies can include back pay, front pay, lost benefits and emotional distress damages, and FEHA allows a winning employee to recover attorney’s fees and costs.
Can I bring a claim if I still work there?
Yes. You do not need to quit or be fired to have a claim, and the law prohibits retaliation for raising a complaint. Talk to a lawyer before making major decisions about your job.
What is the difference between discrimination and harassment?
Discrimination is an adverse decision, such as firing, demotion or denied promotion, because of a protected trait. Harassment is unwelcome conduct like slurs or jokes based on a protected trait that creates a hostile workplace.
How much does an employment discrimination lawyer cost in Los Angeles?
All three firms on this list offer free consultations. Employee-side lawyers commonly work on contingency, taking a percentage only if you recover; Lavi & Ebrahimian publishes a no-recovery, no-fee policy, and the others say to call about fees.
Should I file with the EEOC or the CRD?
California has a work-sharing arrangement, so a complaint filed with one agency is typically cross-filed with the other. Many workers pursue FEHA because of its longer deadlines and broader protections; a lawyer can advise which route fits your case.

Tips if you face discrimination at work
- Write things down as they happen. Dates, names and exact words are far more persuasive than memories months later.
- Keep copies of what you are allowed to keep. Save your own pay stubs, reviews and personal messages, but don’t take confidential company files.
- Report it in writing. A written complaint to HR creates a record and supports any later retaliation claim.
- Don’t sign a severance agreement in a hurry. Many release your claims; have a lawyer review it first.
- Watch the clock. The CRD and EEOC deadlines are strict, so get advice early.
